Terms of Service

1. Acceptance of Terms

By accessing or using Devora DM ("Devora Device Manager," "the Service"), you ("Customer," "you") agree to be bound by these Terms of Service. Devora DM is an enterprise mobility management (EMM) platform that enables organizations to manage their fleet of Android devices using the Android Management API. If you do not agree to these terms, do not use the Service.

2. Description of Service

Devora DM provides enterprise device management capabilities through two modes:

Google EMM Mode (powered by Android Management API):

  • Device enrollment and provisioning (QR code, zero-touch)
  • Policy creation and enforcement (security, applications, network, kiosk mode)
  • Remote device commands (lock, reboot, factory reset, password reset)
  • Application management (install, update, remove via managed Google Play)
  • Device fleet monitoring and compliance reporting
  • Wi-Fi and network configuration deployment

Devora Cloud Mode (Devora Agent app):

  • Device enrollment via company code or QR code
  • Remote device commands (lock, reboot, shutdown, wipe, unlink)
  • Employee-to-device allocation and tracking
  • Device fleet monitoring (battery, connectivity, hardware info)
  • Enterprise asset tracking via device location

When using Google EMM mode, the Service is powered by Google's Android Management API. By using that mode, you also agree to comply with Google's Android Management API Terms of Service and the Android Management API Permissible Usage Policy.

3. Account Registration

To use Devora DM, you must create an account with accurate and complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring that only authorized personnel within your organization access the platform

4. Customer Obligations for Device Management

As a Customer using Devora DM to manage devices, you agree to the following obligations:

4.1. Authorization & Consent

  • You must have proper legal authority to manage all devices enrolled in Devora DM. This includes ownership of the devices or documented consent from device owners.
  • You must inform all end users of managed devices, before enrollment, that their devices will be managed, what data will be collected, and how it will be used.
  • You must obtain and document appropriate consent from end users as required by applicable laws and regulations in your jurisdiction.

4.2. Lawful Use Only

  • You must use Devora DM solely for lawful enterprise device management purposes.
  • You must comply with all applicable laws, regulations, and industry standards (including GDPR, CCPA, and other data protection laws where applicable).
  • You must not use the Service to manage devices belonging to individuals who have not been properly informed and consented.

4.3. Application Deployment

  • You must not push, preload, or auto-install applications on managed devices without the express and informed prior consent of the device user or without a legitimate enterprise management purpose.
  • Applications deployed through Devora DM must comply with Google Play policies and applicable laws.

4.4. Data Responsibility

  • You are the data controller for all device data collected through Devora DM. You are responsible for determining the lawful basis for processing and for responding to data subject requests from your end users.
  • You must have a privacy policy that adequately discloses your use of an EMM platform (Devora DM) and the types of data collected from managed devices.

5. Prohibited Uses

You expressly agree NOT to use Devora DM for any of the following purposes:

  • Device financing or payment enforcement: Using device management capabilities to lock, restrict, or wipe devices as a mechanism to enforce loan payments or financing agreements.
  • Unauthorized surveillance: Monitoring, tracking, or collecting data from devices without proper authorization and informed consent from device users.
  • Advertising or profiling: Using device data for advertising, ad targeting, user profiling, or building marketing databases.
  • Device alteration for resale: Modifying commercial devices' firmware, software, or configurations for the purpose of resale or lease.
  • Non-enterprise personal use: Managing personal devices without an enterprise context or managing devices you do not own or have authorization to manage.
  • Interference: Attempting to gain unauthorized access to the Service, other accounts, or connected systems; interfering with or disrupting the Service or its infrastructure.
  • Reverse engineering: Decompiling, disassembling, or reverse engineering any part of the Service.
  • Illegal activity: Any use that violates applicable local, national, or international laws or regulations.

Violation of these prohibited uses may result in immediate account termination without refund and may be reported to relevant authorities.

6. Free Trial

Devora DM offers a 14-day free trial period. During the trial, you have full access to platform features. After the trial expires, you must subscribe to a paid plan to continue using the Service. We reserve the right to modify or discontinue the trial at any time. A grace period of 3 days after trial expiration allows data export before access is restricted.

7. Subscription & Payments

Paid plans are billed monthly. By subscribing, you authorize us to charge your selected payment method on a recurring basis through our payment provider (Razorpay). You may cancel your subscription at any time, and it will remain active until the end of the current billing period. Refunds are handled on a case-by-case basis.

If payment fails or your subscription lapses, we may restrict access to management features. Enrolled devices will continue to operate under their last applied policy, but you will not be able to modify policies or enroll new devices until payment is resolved.

8. Data Ownership & Processing

You retain ownership of all data you input into Devora DM, including device information, policies, and company data. We do not claim ownership of your data.

You grant us a limited license to process your data solely to provide the Service. We act as a data processor on your behalf for device management data. You, as the Customer, are the data controller and are responsible for ensuring that your use of the Service complies with applicable data protection laws.

9. Google Android Management API

When using Google EMM mode, Devora DM uses the Google Android Management API to provide device management functionality. By using this mode:

  • You acknowledge that device management operations are processed through Google's infrastructure.
  • You agree to comply with Google's terms of service for the Android Management API.
  • You understand that Google may impose usage limits, quotas, or restrictions on API access that could affect Service availability.
  • Enterprise accounts created through Devora DM are subject to Google's enterprise management terms.

Devora Cloud mode communicates directly between the Devora Agent app and the Devora platform. Google's Android Management API terms do not apply to this mode; however, all other terms in this agreement remain in full effect.

10. Affiliate Program

Participants in the Devora DM Affiliate Program earn a 20% commission on payments made by customers they refer. Commissions are calculated on each payment and paid out monthly. We reserve the right to modify commission rates, withhold payments for fraudulent referrals, or terminate affiliate accounts that violate these terms.

11. Service Availability & Support

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance or experience downtime due to circumstances beyond our control, including Google API outages. We are not liable for losses resulting from service unavailability.

Support is available through the in-app support ticket system. We aim to respond to support requests within 24 hours on business days.

12. Limitation of Liability

To the maximum extent permitted by law, Devora DM and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business opportunities, arising from your use of the Service.

Our total aggregate liability for any claims arising from the Service shall not exceed the total fees paid by you in the 12 months preceding the claim.

We are not responsible for any actions taken on managed devices as a result of policies configured by the Customer. Customers are solely responsible for the policies they create and deploy.

13. Indemnification

You agree to indemnify and hold harmless Devora DM and its operators from any claims, damages, losses, or expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of end users or third parties; (d) device management actions taken through your account; (e) your failure to comply with applicable laws or obtain required consent from end users.

14. Termination

We may suspend or terminate your account at any time for violation of these terms, including prohibited uses. You may terminate your account by contacting support.

Upon termination:

  • Your right to use the Service ceases immediately
  • Enrolled devices will continue to operate under their last applied policy until manually unenrolled or factory reset
  • We will retain your data for 90 days to allow for data export, after which it will be permanently deleted
  • Payment obligations for the current billing period remain in effect

15. Changes to Terms

We may update these terms from time to time. We will notify Customers of material changes via email and/or in-app notification at least 30 days before the changes take effect. Continued use of the Service after changes constitutes acceptance.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in India.
